TERMS OF SERVICE — SnapSort Application

Version 1.0 — effective as of 03.10.2026

This English version is the authoritative and legally binding version of these Terms of Service. A Polish translation may be made available for convenience only; in the event of any discrepancy between the language versions, this English version prevails. The Application is governed by Swiss law.

§ 1. Introductory provisions

  1. These Terms of Service (the “Terms”) set out the rules for using the mobile application SnapSort (the “Application”), including the rights and obligations of its users and the scope of liability of the entity that makes the Application available.
  2. The entity making the Application available is Wojciech Radko, acting as a sole proprietor, correspondence address: c/o JL Consulting Group GmbH #1671, Zürcherstrasse 84, 8852 Altendorf, Switzerland, contact e-mail: [email protected] (the “Provider”).
  3. Downloading, installing or using the Application in any way constitutes confirmation that the user has read these Terms, accepts them, and undertakes to comply with them. A person who does not accept these Terms is not entitled to use the Application and should uninstall it.
  4. The Application is intended for professional use (a business-to-business relationship) and is directed to individuals and entities conducting professional or business activity. The Application is not directed to consumers within the meaning of Article 22(1) of the Polish Civil Code.
  5. The Terms are made available free of charge, in a manner that allows them to be obtained, reproduced, recorded and printed.

§ 2. Definitions

The following terms shall have the meanings set out below:

  1. Application – the SnapSort software, in its mobile version, together with all its functionalities, updates and documentation.

  2. Provider – the entity indicated in § 1(2) that makes the Application available.

  3. User – a natural person, legal person or organisational unit without legal personality that has downloaded, installed or uses the Application in connection with its professional or business activity.

  4. Device – an iPhone smartphone meeting the technical requirements set out in § 4, on which the Application is installed.

  5. Content – any data entered, stored or processed by the User in the Application, in particular photographs, descriptions, categories, metadata and personal data.

  6. Cloud Service – the iCloud Drive service provided by Apple, within which – under the User’s Apple account – the Application’s data is stored and synchronised. The Provider is not the provider of this service and has no control over it.

  7. Export – the Application’s function enabling the creation of a ZIP file containing photographs and related data.

  8. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation).

  9. Store – the application distribution platform through which the Application is made available (App Store and equivalents).

  10. Terms – this document.

§ 3. Purpose of the Application

  1. The Application constitutes solely an auxiliary tool for organising, sorting and cataloguing photographs taken by the User in the course of their professional activity (including in the medical, beauty and veterinary sectors).
  2. The Application is not a medical device within the meaning of applicable laws and was not designed, certified or intended for medical use in a diagnostic or therapeutic sense.
  3. In particular, the Application does NOT: a) perform medical diagnoses or any other clinical assessments; b) make or support therapeutic, treatment or procedural decisions; c) analyse, interpret or process photographs using artificial intelligence (AI) or machine-learning mechanisms; d) provide health, medical, cosmetic or veterinary advice.
  4. The functionalities of the Application include, in particular: cataloguing and organising photographs, exporting photographs and data to ZIP files, optionally applying watermarks to photographs, and the Integrity Report (an SHA-256 checksum) enabling verification of the integrity of photographs and detection of any subsequent modification. The watermark is an optional function, disabled by default, and is currently applied solely to the copies of photographs created during Export; in the present version of the Application the original photographs are stored without modification.
  5. All medical, therapeutic, cosmetic, veterinary or business decisions are made solely by the User, based on their own professional knowledge, qualifications and the rules and standards applicable to them, regardless of the use of the Application.
  6. The Application does not replace professional medical records or systems for maintaining them. The User independently ensures that any required documentation is kept in a lawful manner by separate means.

§ 4. Technical requirements

  1. The proper use of the Application requires a Device meeting the following minimum requirements: a) an operating system in the version indicated in the Application’s description in the Store (iOS 18.0 or later); b) sufficient free storage on the Device for photographs and data; c) — for synchronisation of data with iCloud Drive — an active, properly configured Apple account with iCloud Drive enabled, and access to the Internet.

  2. The Provider does not guarantee the proper functioning of the Application on Devices that do not meet the technical requirements, that have been modified (e.g. jailbroken), or in non-standard environments.

  3. The User bears, at their own expense, the costs of data transmission, Device maintenance and Cloud Services.

§ 5. Data storage rules

  1. The User’s photographs and data are stored locally on the User’s Device and synchronised with the Cloud Service (iCloud Drive) under the User’s Apple account. The Application also works without an Internet connection — photographs and the folder structure are created locally on the Device, and their synchronisation with iCloud Drive takes place once a connection is re-established. The scope and manner of synchronisation depend on the iCloud Drive settings controlled by the User in the Device’s operating system.

  2. The Provider has no access and does not obtain access through the Application to photographs, patient data or other User Content. The Provider does not collect, store or process Content on its own servers.

  3. The configuration, operation, availability and security of the Cloud Service are beyond the Provider’s control and are governed solely by the terms and policies of the entities providing those services. The Provider is not a party to the relationship between the User and the Cloud Service provider.

§ 6. User responsibility

  1. The User uses the Application at their own responsibility and risk, in a manner consistent with the law, these Terms, good practice and the rules of professional ethics.
  2. The User bears sole responsibility for: a) the compliance of the use of the Application with the GDPR and other personal data protection regulations; b) the compliance of the use of the Application with regulations concerning medical records and with regulations concerning professional secrecy (including medical, veterinary and other applicable secrecy); c) obtaining all required consents, in particular the consents of persons whose image or data are recorded in photographs; d) the legality, content and manner of use of Content entered into the Application and exported from it; e) securing the Device, the Cloud Service and access to the Application against access by unauthorised persons; f) creating backups in accordance with § 7.
  3. The User, or the entity on whose behalf the User acts (e.g. a clinic or practice), is the controller of the personal data processed using the Application and independently fulfils all obligations under the GDPR, including information obligations, ensuring a legal basis for processing, and handling the rights of data subjects.
  4. The User undertakes not to use the Application for medical purposes in a diagnostic or therapeutic sense, or in a manner suggesting that the Application performs such functions.
  5. The User releases the Provider from liability and undertakes to remedy damage and satisfy justified claims of third parties (including patients, clients and authorities) brought against the Provider that result from the User’s breach of the law, these Terms or the rights of third parties in connection with the use of the Application — to the extent permitted by law.

§ 7. Backups and data security

  1. The User bears full and sole responsibility for creating and storing backups of all photographs and data stored in the Application.
  2. The Provider strongly recommends regularly creating backups of Content, independently of the Application and the Device.
  3. The Application is not a tool for creating or guaranteeing backups and does not provide a mechanism for recovering lost or damaged data.
  4. The Provider is not responsible for the security of data stored on the Device or in the Cloud Service, which remain beyond its control.

§ 8. Limitation of the Provider’s liability

  1. The Application is provided “as is” and “as available”. The Provider makes no warranties as to the Application’s fitness for a particular purpose, or its uninterrupted, error-free or secure operation.
  2. The Provider informs the User, and the User acknowledges and accepts, that the Application may contain programming errors, defects and imperfections and may operate in an unforeseen manner.
  3. To the fullest extent permitted by applicable law, the Provider shall not be liable for any damage, loss or adverse consequences arising out of or in connection with the use of, or inability to use, the Application, in particular for: a) loss of data; b) corruption of data; c) erroneous, faulty or improper operation of the Application; d) unavailability of the Application, interruptions in its operation or its suspension; e) loss of photographs; f) erroneous, incomplete or failed Exports (including faulty ZIP files); g) erroneous, incorrect or incomplete cataloguing and organising of photographs; h) the consequences of any medical, therapeutic, cosmetic, veterinary or business decisions made by the User; i) the User’s breach of the GDPR or other personal data protection regulations; j) loss of access to the Cloud Service, its failures, limitations or discontinuation by third parties; k) financial damage, indirect damage, lost profits, loss of contracts, goodwill or anticipated savings.
  4. The Provider is not liable for the operation of the Device, the operating system, the Store, the Internet, Cloud Services or any other third-party software or services over which it has no control.
  5. The Provider’s liability under statutory warranty for defects is excluded to the fullest extent permitted by Swiss law (Article 199 of the Swiss Code of Obligations – Obligationenrecht, OR).
  6. If, notwithstanding the provisions of paragraphs 1–5, the Provider’s liability is established, it shall be limited solely to actual damage (excluding lost profits) and to the higher of the following amounts: a) the total amount paid by the User through the Store for SnapSort Pro during the 12 months preceding the event giving rise to the damage, or b) CHF 100 (one hundred Swiss francs).
  7. The limitations of liability set out in this paragraph do not cover liability that, under mandatory provisions of law, cannot be excluded or limited in advance, in particular liability for damage caused intentionally or through gross negligence (Article 100 of the Swiss Code of Obligations – Obligationenrecht, OR).

§ 9. Personal data and GDPR

  1. Given the manner in which the Application operates as described in § 5, the Provider has no access to Content, including the personal data of the User’s patients or clients, and does not process such data on the User’s behalf.
  2. The controller of the personal data processed using the Application is the User, or the entity on whose behalf the User acts (e.g. a clinic or practice). That controller independently determines the purposes and means of processing such data and fulfils all controller obligations under the GDPR. The Provider is not the controller of that data.
  3. The Provider may process a limited scope of technical or contact data necessary to make the Application available and to handle inquiries (e.g. an e-mail address when contacting). The rules of such processing are set out in a separate Privacy Policy, available at https://www.snapsort.io/en/privacy.
  4. The User acknowledges that it is the User, and not the Provider, who is obliged to ensure a legal basis for processing the data of persons whose image or data are recorded in the Application, and to fulfil information obligations towards those persons.
  5. To the extent that the Cloud Service involves the processing of personal data, the User independently concludes the required agreements with the Cloud Service provider (including any data processing agreement).

§ 10. Intellectual property

  1. All rights to the Application, including economic copyrights, rights to the source code, interface, graphics, trademarks, the name “SnapSort” and other elements of the Application, belong to the Provider or to entities with which the Provider has concluded appropriate agreements, and are subject to legal protection.
  2. The Provider grants the User a non-exclusive, non-transferable, revocable licence to use the Application solely in accordance with its purpose and these Terms, for the period of use of the Application. The licence does not include the right to grant sub-licences.
  3. The User is not entitled, in particular, to: copy, modify, decompile, disassemble, reverse-engineer the source code (beyond the scope strictly permitted by law), distribute, rent, resell, or create derivative works of the Application.
  4. Content entered by the User (including photographs) remains the property of the User or of authorised third parties. The Provider acquires no rights to it and no access to it.
  5. Watermarks generated by the Application do not infringe the Provider’s rights to the Application; the User is responsible for the content and use of watermarks.

§ 11. Application updates

  1. The Provider may, but is not obliged to, make updates to the Application available, including bug fixes, changes to functionality or security.
  2. Updates may be a condition for the continued proper functioning of the Application. The Provider does not guarantee the compatibility of the Application with future versions of operating systems or Devices.
  3. The Provider reserves the right to change, limit, suspend or discontinue making the Application or any of its functionalities available at any time, to the extent permitted by law, without incurring any liability in this respect. The Provider will announce any intention to permanently discontinue making the Application available on https://www.snapsort.io at least 90 days in advance. The User’s Content will remain accessible in accordance with § 12(13).
  4. Installation, downloading and management of updates may take place via the Store and are subject to its rules.

§ 12. Paid features, subscriptions and payments

  1. The Application is made available free of charge in its base version (“Starter”). Installing the Application, taking photographs, assigning them to patients and visits, organising them into the folder structure and storing them in the User’s iCloud Drive are permanently free of charge and require neither payment nor the provision of payment details.
  2. The Starter version allows photographs to be taken, assigned to patients and visits and organised into the folder structure, and imposes no limit on the number of practices created, patients, visits or photographs. It includes Export for the “Today” and “This week” ranges. The following limits apply to the Starter version: a) only one practice may be active at a time; further practices may be created and remain fully visible, but activating a different one requires SnapSort Pro; b) Export for a monthly or custom date range, the Integrity Report, watermarking of exported photographs and the import of a patient list from a CSV file are not available.
  3. Selected additional functionalities (collectively “SnapSort Pro”) are made available for a fee. SnapSort Pro comprises: an unlimited number of active practices, Export for a monthly or custom date range, the Integrity Report referred to in § 3(4), optional watermarking of photographs during Export, and the import of a patient list from a CSV file.
  4. SnapSort Pro is offered in the following variants: a) an annual subscription, renewing automatically for successive twelve-month periods until cancelled; b) a one-off purchase (“Lifetime”), which does not renew and does not involve any recurring payment.
  5. Prices are those displayed in the Store for the User’s territory at the time of purchase, inclusive of any applicable taxes. Prices differ between territories and may change. Prices stated on the Provider’s website or in marketing materials are indicative and do not constitute an offer within the meaning of the Swiss Code of Obligations.
  6. All payments are processed by Apple through the Store, in accordance with Apple’s terms applicable to the User. The Provider is not a party to the payment transaction, does not receive full payment details, and does not issue invoices for Store purchases. The purchase is charged to the User’s Apple Account.
  7. Automatic renewal. The annual subscription renews automatically at the end of each period unless the User cancels it at least 24 hours before the end of the current period. The renewal charge is applied by Apple within 24 hours before the start of the new period.
  8. Cancellation. The User may cancel the subscription at any time in the Apple Account settings in the Store. Cancellation is effective from the end of the current paid period; SnapSort Pro functionalities remain available until then. The subscription cannot be cancelled through the Provider, and the Provider has no technical ability to cancel it on the User’s behalf.
  9. Free trial period. The Provider makes the SnapSort Pro functionalities available free of charge for an introductory period of 30 days. The trial period requires neither a purchase nor the provision of payment details, is not an introductory offer within the Store, and does not convert automatically into a paid subscription. The trial period begins on the first actual use of the Application — the saving of the first photograph, the addition of the first patient, or the completion of the first import of a patient list — and not upon installation. The trial period is granted once per device and does not begin anew upon reinstallation of the Application. On its expiry the Application reverts to the Starter version referred to in paragraphs 1 and 2, unless the User has purchased one of the variants referred to in paragraph 4.
  10. Refunds are handled by Apple in accordance with Apple’s terms. The Provider is not able to grant, process or refuse a refund for a purchase made through the Store. Requests for refunds should be addressed to Apple. Reports of the Application malfunctioning, regardless of any refund request, may be sent to the e-mail address given in § 1(2); the Provider will respond within 14 days.
  11. Price changes. A change in the price of the annual subscription takes effect from the next billing period following notification made through the mechanisms provided by Apple. Where Apple’s terms so require, continued renewal is subject to the User’s consent to the new price. A price change does not affect a Lifetime purchase already made.
  12. Scope of the Lifetime variant. A Lifetime purchase releases the User from any recurring payment for SnapSort Pro for as long as the Application is made available by the Provider. It does not oblige the Provider to maintain, develop or continue to make the Application available indefinitely, and does not limit the Provider’s rights under § 11(3). It does not confer any right to functionalities added to the Application in the future as separate paid products.
  13. Effect of the expiry or cancellation of SnapSort Pro. Where the trial period expires, or a subscription expires (including, following its cancellation, at the end of the paid period), the Application reverts to the Starter version and the SnapSort Pro functionalities cease to be available. Photographs, the folder structure and the User’s other Content remain unchanged in the User’s iCloud Drive and are not deleted, restricted or made inaccessible by the Provider, and remain readable through the Files application and the Finder irrespective of the version in use. Practices which cease to be active likewise remain fully visible in the Application together with all data assigned to them. No pro-rata refund is made for an unused part of a paid period.

§ 13. Termination

  1. The User may stop using the Application and uninstall it at any time, which is equivalent to termination of the agreement for the use of the Application. Uninstalling the Application does not cancel the subscription; the subscription must be cancelled in the Apple Account settings in accordance with § 12(8).
  2. The Provider may discontinue making the Application available or revoke the licence referred to in § 10(2) if the User breaches these Terms or the law, as well as for other justified reasons, to the extent permitted by law.
  3. Termination of the agreement does not release the User from the obligation to independently secure Content. The Provider is not responsible for loss of access to Content in connection with uninstalling the Application or discontinuing its availability.
  4. Provisions which by their nature should survive termination of the agreement (in particular § 6, § 8, § 9, § 10 and § 12) shall remain in force.

§ 14. Final provisions

  1. The Provider reserves the right to amend these Terms for important reasons, in particular in the event of changes in the law, changes to the Application’s functionality or changes to the Provider’s details. The User will be informed of any amendment to the Terms by publication of a new version of the Terms on https://www.snapsort.io at least 30 days before the date of its entry into force; changes required by law may take effect earlier. Continued use of the Application after the amendments take effect constitutes acceptance thereof.
  2. In matters not regulated by these Terms, the provisions of Swiss law shall apply, in particular the Swiss Code of Obligations (Obligationenrecht, OR) and the Swiss Copyright Act (Urheberrechtsgesetz, URG).
  3. The law applicable to these Terms and to the relationships arising from the use of the Application is Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
  4. The courts of the Canton of Zurich, Switzerland (place of jurisdiction: Zurich) shall have exclusive jurisdiction over any disputes arising from these Terms or from the use of the Application by a User who is an entrepreneur. This provision does not limit the rights of a User who is a consumer arising from mandatory provisions of law, including any right to bring an action before the court having jurisdiction over their place of residence.
  5. If any provision of these Terms is found to be invalid or ineffective, the remaining provisions shall remain in force, and the invalid provision shall be replaced by a provision closest to the economic purpose of the invalid provision, consistent with the law.
  6. The titles of the paragraphs are for convenience only and do not affect the interpretation of these Terms.
  7. These Terms enter into force on 03.10.2026.
